We begin processing the foreclosure the same day the referral is received. Referrals may be submitted via e-mail to kmc@dgandl.com, and Next Day Air, U.S. Mail, or facsimile transmission to our Beverly offices. We promptly order the foreclosure certificate/title report and, if necessary, send a default letter to the debtor.

Court appointed referees provide us with a foreclosure certificate at a cost set by statute within ten days. Upon receipt of the foreclosure certificate certifying the necessary party defendants, we draft the Summons, Complaint and Notice of Pendency and send these pleadings to our clients via e-mail to review and execute. We then file the Summons, Verified Complaint, and Notice of Pendency and begin serving each of the necessary parties. After each defendant is properly served and the time to answer has expired, we file our motion for reference to a Court appointed individual called a Referee who reviews the report of the amounts due on the loan obligation prepared by our office and executes same. We then file a motion to confirm this report and to enter the judgment of foreclosure. The day we receive the executed judgment from the court, we begin scheduling the foreclosure sale. Depending on the schedule of the Referee, we are generally able to conduct the sale within 40 days of receipt of the judgment.

The final step is to attend the auction of the property at the courthouse. The sale is conducted by the Referee and our agent is present to bid on behalf of our client, answer questions, make certain the proper paper work is completed and obtain information from interested parties. We then prepare the Deed, Report of Sale, and Tax Forms for signatures, and recording. If the property is sold to a third-party, we attend the closing, receive and distribute any third party funds.

Legal services are also available for intervening bankruptcies. We will enter a Notice of Appearance, prepare and file a Proof of Claim, file an Objection to the debtor’s Chapter 13 plan if it does not provide for the client’s entire debt, file a Motion for Relief from the Automatic Stay as soon as cause exists, and attend any emergency hearings, cram down or adversary proceedings.

Following the foreclosure, we will promptly send a Notice to Quit (within 24 hours of referral) and we will proceed to complete the eviction proceedings necessary to obtain a Writ of Assistance or Warrant. During the eviction process our attorneys continually strive to settle the matter and obtain a vacant property as quickly as possible to facilitate the re-sale.

With over 15 years of real estate closing experience, we are also able to handle our client’s REO closing needs. Knowledge is power and often times we are able to bring a matter to a quicker resolution with the information gained during each phase of the foreclosure process. The distinguishing feature of our representation of our clients throughout the New York process is not how we handle the "run of the mill" cases but how we handle the difficult cases. We often handle cases that involve problem assets as well as cases that have been transferred from one attorney to another. We quickly discern the problems and work to expedite resolution.
