First Circuit Affirms Emigrant Residential’s Mortgage Rights in Landmark Appeal

We’re thrilled to announce a major appellate win secured by our firm on behalf of our client, Emigrant Residential, LLC, in the closely-watched case of Emigrant Residential, LLC v. Pinti, Appeal No. 24-1404, ---F.4th---, 2025 WL 1088134. On April 11, 2025, the United States Court of Appeals for the First Circuit handed down a decisive opinion affirming our client’s rights and reinforcing key legal principles in complex mortgage litigation.


The First Circuit upheld the district court’s grant of summary judgment in favor of Emigrant, confirming that a mistakenly recorded mortgage discharge could rightfully be struck from the record. The Court further dismissed all counterclaims brought by the appellant—including allegations of unclean hands and violations of Massachusetts consumer protection laws—delivering a clean sweep for our client.


In a comprehensive and thoughtful opinion, the Court acknowledged Emigrant’s valid legal and equitable interest in the mortgage and note, underscoring our client’s standing and enforceable rights. Importantly, the Court determined that the discharge at issue was clearly an administrative error, validating the legal and strategic positions we advanced throughout every stage of the litigation.
